Terms of Service

These terms apply to your use of GP Data (data.gpmech.com and the installed app), provided by GP Mechatronics ("we", "us"). By using GP Data you agree to them. If you don't agree, please don't use it. How we handle data is set out in our Privacy Policy.
1. Safety: please read
Motorsport is dangerous. Riding and driving on track carries a real risk of serious injury and death, to you and to others.
- GP Data's figures, calculations, simulations (including vehicle dynamics, loads, lean angles, gearing and lap times), syncing between files, and video overlays can be wrong or incomplete. They depend on your data, the settings you enter, and simplifying assumptions, and may contain errors.
- Don't rely solely on GP Data for any decision that could affect your safety or anyone else's: changes to your vehicle or its setup, braking points, speeds or lines. Check against your vehicle maker's specifications, test changes safely, and take advice from qualified people.
- GP Data isn't professional engineering, coaching or medical advice, and doesn't replace them.
- Never use GP Data while you are riding or driving.
- You are responsible for your vehicle, your setup, how you ride or drive, and following the rules of the track or event. We can't foresee every way GP Data might be used, and you use it at your own risk.
2. The service
GP Data lets you open, plot and analyse data logs, videos and simulations. Its free features need no account. GP Data Pro adds further features for a subscription. We may improve, change or remove features over time.
3. Your data
Your data is yours. It's stored in your browser on your device, not on our servers (see the Privacy Policy). You are responsible for keeping backups: browsers can clear their storage, devices get lost, and we can't recover data we never had. Using GP Data as it is today gives us no rights over your data. Any change to that would apply only after we update these terms and our Privacy Policy and tell you, and never to GP Data Pro (see the Privacy Policy, "Future changes").
4. Accounts
An account is for one person. Use an email address you control, keep access to it (sign-in codes are sent there), and don't share your account. You can delete your account at any time from the app (User → Account → Delete My Account).
5. Subscriptions and billing
- Pro is billed monthly or yearly, at the price shown when you subscribe, through Stripe. Prices may include or exclude taxes depending on where you live.
- Your subscription renews automatically at the end of each period until you cancel.
- You can cancel at any time with Manage Subscription (User → Account). You keep Pro until the end of the period you've paid for, and you won't be charged again.
- If we change the price, we'll tell you in advance. The new price applies from your next renewal, and you can cancel before then.
- If a payment fails, Pro may be paused until it's resolved.
6. Refunds
Payments are non-refundable, including for the unused part of a monthly or yearly period. The monthly plan is the low-cost way to try Pro. We will always refund a billing mistake, such as a duplicate charge or a charge after you cancelled, if you tell us within 30 days at support@gpmech.com. Nothing in these terms limits any refund or cancellation rights you have under the law where you live.
7. Acceptable use
Please don't: share or resell access to Pro; try to get around how Pro is licensed or unlocked; copy, reverse engineer or redistribute GP Data's own code (except as the law allows); interfere with the service or other people's use of it; or use it to break the law.
8. Ownership
GP Data, its design and its code belong to us. Open-source components it includes are used under their own licences. The data you load, and what you make from it, remain yours.
9. Other services
GP Data uses services run by others, including Stripe for payments, map providers for map images, and Google Drive if you connect it. Their own terms apply to your use of them.
10. No warranty
GP DATA IS PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF ACCURACY, RELIABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DON'T PROMISE THAT GP DATA WILL BE ERROR-FREE OR UNINTERRUPTED, OR THAT ITS RESULTS WILL BE CORRECT.
11. Limitation of liability
TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES, OR FOR LOSS OF DATA, PROFITS, OR DAMAGE TO VEHICLES OR PROPERTY, OR PERSONAL INJURY, ARISING FROM YOUR USE OF GP DATA OR RELIANCE ON ITS RESULTS. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM. Some places don't allow these limits, so they may not all apply to you; where that's the case, our liability is limited as far as the law permits.
12. Your responsibility
To the extent the law allows, you agree to cover us against claims by others arising from your use of GP Data in breach of these terms or the law.
13. Ending
You can stop using GP Data at any time. We may suspend or end an account that breaks these terms. We may discontinue GP Data or Pro; if we discontinue Pro, we'll give reasonable notice and refund any unused paid period.
14. Changes to these terms
If we change these terms, we'll update the date at the top, and for significant changes let you know in the app or by email before they take effect. Using GP Data after that means you accept the new terms.
15. Law
These terms are governed by the laws of [your state and country], without affecting any consumer protection you have where you live.
